These Terms of Use (“Terms”) govern access to and use of https://nelsonandco.net and pages operated by Nelson & Co., LLC (“Nelson & Co.,” “we,” “us,” or “our”) that link to these Terms (collectively, the “Site”). By using the Site, you agree to these Terms. If you do not agree, do not use the Site.
The Site provides general information about Nelson & Co., its marketing, communications, web design, development, graphic design and related services, experience, portfolio and business content. The Site is intended primarily for users and organizations located in the United States.
Use of the Site, submission of an inquiry, scheduling of a consultation or other preliminary communication does not create an agency-client, professional-services, fiduciary or other business relationship and does not obligate either party to proceed. Services are provided only under a separate written agreement accepted by Nelson & Co. and the client. Site content is general information and is not legal, tax, accounting, financial or other regulated professional advice.
You may use the Site only for lawful purposes. You may not interfere with Site security or operation; attempt unauthorized access; introduce malware or harmful code; submit deceptive, abusive, infringing or unlawful material; impersonate another person; harvest personal information; or use automated systems in a manner that unreasonably burdens the Site. Ordinary indexing by legitimate search engines is permitted.
Unless otherwise indicated, the Site and its original content, design, graphics, logos, text and arrangement are owned by or licensed to Nelson & Co. and protected by intellectual-property laws. You may view and print reasonable portions for personal, internal and noncommercial evaluation of our services. No other license is granted. Client names, logos, projects and third-party marks remain the property of their respective owners and are displayed for identification, portfolio or illustrative purposes as applicable.
You represent that information submitted through the Site is accurate, that you have the right to provide it, and that it does not violate another person’s rights. Do not submit confidential, proprietary, health, payment-card, financial-account, government-identifier or other sensitive information through a general inquiry form unless we specifically request it through an approved method. If you ask us to contact you, we may respond using the contact information you provide and may maintain a record of the inquiry for ordinary business purposes. Marketing communications are optional. These limitations do not apply where prohibited by law.
To the extent permitted by law, you agree to defend, indemnify and hold harmless Nelson & Co. and its members, officers, employees, contractors and agents from third-party claims, losses and expenses arising from your unlawful use of the Site, material violation of these Terms, or content you submit.
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. Any legal action relating to the Site or these Terms must be brought in a state or federal court having jurisdiction in Fort Bend County, Texas, and each party consents to that jurisdiction and venue, except where applicable law requires otherwise.
We may update these Terms to reflect changes in the Site, law or business practices. The revised version will be posted with a new effective date. Changes apply prospectively when posted unless applicable law requires otherwise. Continued use after the effective date constitutes acceptance of the revised Terms.
If a provision is held unenforceable, it will be limited to the minimum extent necessary and the remaining provisions will remain effective. Failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent. We may assign them in connection with a reorganization, merger, sale or transfer of the Site or business.
These Terms and the Privacy Policy govern use of the Site. A separate signed client agreement governs services and controls if it conflicts with these Terms regarding those services.
