Nelson & Co., LLC (“Nelson & Co.,” “we,” “us,” or “our”) respects your privacy. This Privacy Policy explains how we collect, use, disclose and protect personal information through https://nelsonandco.net and related pages that link to this Policy (the “Site”), and when you communicate with us about our services.

1. Scope and Intended Audience

This Policy applies to Site visitors, prospective clients, business contacts and others who interact with us through the Site. The Site and our services are directed primarily to persons and organizations in the United States. We may restrict access from other countries. This Policy does not govern information we process solely on behalf of a client under a services agreement, or third-party websites and services that maintain their own privacy policies.

2. Personal Information We Collect

  • Contact and inquiry information, including name, company, email address, telephone number, message content and communication preferences.

  • Professional and business information you choose to provide about an organization, role, project or requested service.

  • Scheduling information provided through Microsoft Bookings, including contact details and appointment selections.

  • Marketing information, including newsletter choice, subscriber status, messages sent, opens, clicks and unsubscribe activity.

  • Device and usage information, including IP address, browser, device type, operating system, referring page, pages viewed, interactions, approximate location and date or time.

  • Cookie, analytics, security and anti-abuse information, including information processed through Google Analytics and Cloudflare Turnstile.

  • Other information you choose to provide. Please do not submit sensitive personal information through a general inquiry form unless requested through an approved method.

3. How We Collect Information

  • Directly from you when you submit a form, schedule a meeting, subscribe, email, call or otherwise communicate with us.

  • Automatically from your browser or device through server logs, cookies, analytics and security technologies.

  • From service providers that support the Site and our business operations.

  • From referrals, public business sources, professional networks or business partners when relevant to a potential or existing business relationship.

4. How We Use Personal Information

  • Respond to inquiries, schedule consultations and communicate about requested services.

  • Evaluate, prepare and manage proposals, projects and client relationships.

  • Maintain prospective-client and ordinary business records in the Site, email, SharePoint, Todoist or related systems.

  • Send newsletters or marketing communications when the recipient has subscribed or as otherwise permitted by applicable law.

  • Operate, maintain, secure, troubleshoot and improve the Site.

  • Measure Site traffic, content performance and marketing effectiveness.

  • Prevent fraud, spam, abuse and security incidents.

  • Comply with legal obligations, enforce agreements and protect rights.

5. Contact Forms and Business Records

When you submit a contact form, the entry is stored in the Site database and a notification is generally sent to [email protected] through Microsoft 365. Authorized WordPress users with appropriate administrative or editorial permissions may access form entries. If an inquiry becomes a potential business opportunity, relevant information may also be recorded in Microsoft SharePoint or Todoist for follow-up and business administration. Form submission data is automatically deleted from the Site database approximately 90 days after submission. Relevant information may be retained in our email, business-management systems, backups, or other records as described in this Policy.6. Email Marketing and Campaign Monitor

Email marketing is optional. If you affirmatively choose to subscribe, your name, email address, subscription choice and related information may be transmitted through the Gravity Forms Campaign Monitor integration and stored by Campaign Monitor. The integration should be configured so a submission is sent to Campaign Monitor only when the subscription condition is satisfied. Marketing messages include an unsubscribe link. Campaign Monitor generally records unsubscribed addresses on a suppression list to help prevent accidental re-enrollment. We may retain subscription and suppression records as needed to document and honor your preference. We may still send nonmarketing communications relating to an inquiry, appointment, project, contract, security matter or legal notice.

7. Cookies and Similar Technologies

The Site uses cookies and similar technologies for security, performance, preferences and analytics. Google Analytics may collect IP address, device, browser, approximate location, referral, page-view and interaction information through cookies or similar identifiers. The Site also uses or embeds services such as Microsoft Bookings, Cloudflare Turnstile and social-media content or links. These providers may receive technical and interaction information under their own terms and policies. Where required, we request consent before using nonessential cookies. You may also restrict cookies through your browser, although doing so may affect Site functions.

8. How We Disclose Personal Information

  • Service providers and contractors supporting hosting, forms, email, email marketing, scheduling, analytics, DNS, security, backups, file storage, IT and business administration.

  • Business or referral partners when you ask us to coordinate with them or when reasonably necessary to respond to your request.

  • Government authorities, courts, advisers or other parties when reasonably necessary to comply with law, legal process, protect rights or investigate fraud or security concerns.

  • A buyer, successor, lender or adviser in connection with a proposed or completed merger, financing, reorganization, sale or transfer of some or all of the business or assets.

  • Other parties with your direction or consent.

9. No Sale or Behavioral-Advertising Sharing

Nelson & Co. does not sell, rent or exchange personal information. We do not currently share personal information for cross-context behavioral advertising or targeted advertising as those concepts are defined by applicable state privacy laws. If our practices materially change, we will update this Policy and provide any choices required by law.

10. Service Providers

Service providers supporting our operations may process, store, transmit, back up or have limited technical access to personal information while performing services for us. These providers may include Nexcess for website hosting and backups; Cloudflare for DNS, security and Turnstile; Microsoft 365 for email and business communications; Microsoft Bookings for scheduling; Campaign Monitor for opted-in email marketing; Google Analytics or Google Site Kit for Site analytics; Dropbox for off-server website backups; and Microsoft SharePoint or Todoist for qualified-lead follow-up and business administration. We do not authorize these providers to use personal information for unrelated purposes, subject to their applicable agreements and independent legal obligations.

11. Data Retention

We retain personal information for as long as reasonably necessary to respond to inquiries, manage business relationships, maintain subscription and suppression records, comply with legal obligations, resolve disputes and protect our legitimate interests. Entries may be manually deleted when no longer needed. Information may remain in routine hosting or off-server backups until those backups are overwritten, deleted or retired in the ordinary course. Unsubscribe or suppression records may be retained to ensure that marketing preferences continue to be honored.

12. Data Security

We use reasonable administrative, technical and physical safeguards designed to protect personal information, including access-controlled systems, spam-prevention tools and service providers supporting website and account security. No transmission or storage method is completely secure, and we cannot guarantee absolute security.

13. Privacy Choices and Requests

You may unsubscribe from marketing email using the link in the message. You may also ask to access, correct or delete personal information associated with an inquiry, or ask questions about our practices, by contacting [email protected]. Damien Nelson generally receives and responds to privacy requests. We may need to verify your identity and authority before acting. We will consider reasonable requests and will provide rights required by applicable law. We may retain information when reasonably necessary to comply with law, establish or defend legal claims, complete transactions, maintain security, or preserve an unsubscribe preference.

14. State Privacy Laws

Some U.S. state privacy laws apply only when a business meets specified revenue, data-volume, data-sale or other thresholds. Nelson & Co. is a small business and does not sell sensitive personal information. If a comprehensive state privacy law applies to a particular request, we will provide the rights and response process required by that law. Nothing in this Policy limits rights that cannot lawfully be limited.

15. Children’s Privacy

The Site is intended for business audiences and is not directed to children under 13. We do not knowingly collect personal information from children under 13 through the Site. If you believe a child has provided such information, contact us so we can review and delete it as appropriate.

16. Third-Party Sites

The Site may link to or embed third-party services. We do not control their privacy or security practices. Review their policies before providing information.

17. Changes to This Policy

We may update this Policy to reflect changes in law, technology or business practices. We will post the revised Policy with a new effective date and provide additional notice when required. Material changes will not be applied retroactively where prohibited.
